Privacy Policy for Customers in EEA

Yanmar Corporation. (“we”), in connection with the provision of the products and services to customers (the "Customers") residing in the European Economic Area* (the "EEA"), for the purpose of complying with the EU General Data Protection Regulation (the "GDPR") and of appropriately processing the personal data of the Customers residing in the EEA, hereby establishes this "Privacy Policy" (this "Privacy Policy").

1. Processing Personal Data

(1) Definitions

"Personal data" means any data relating to an identified or identifiable natural person, including, without limitation, name, address, date of birth, telephone number, e-mail address and user IDs of the Customers residing in the EEA.
"Processing" means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
"Controller" means a legal person, etc. which, alone or jointly with others, determines the purposes and means of the processing of personal data.
"Processor" means a legal person, etc. which processes personal data on behalf of the Controller.

(2) Date Controller

The controller of the Customers’ personal data is Yanmar Corporation. ( 1-32 Chayamachi, Kita-ku, Osaka 530-0013, Japan CEO; Representative Director: Takehito Yamaoka).

(3) Types of Personal Data to Be Collected

We will collect the following types of personal data concerning Customers in connection with the products and services

  • (a) Contact information (e.g. names, phone numbers, addresses, email addresses, location information etc.)
  • (b) Transaction information (e.g. inquiries, purchases, customer service, etc.)
  • (c) Usage information (e.g. personal preferences such as purchase history, online activity history, demographic information, etc.)

(4) Purposes of Use of Personal Data

We will process the Customers' personal data for the following purposes

(a) Relevant Transactions:

  • To provide the products and services and send transactional documents such as invoices
  • For business-related communications
  • To respond to the Customers' inquiries or requests, and for confirmation and documentation purposes

(b) Customer Support:

  • To provide and perform after-sales service, periodic inspections, maintenance, etc., for our services and products
  • To fulfill contractual or legal obligations
  • To solicit participation in customer satisfaction surveys and other questionnaires in relation to our services and facilities

(c) Improvement of the Services:

  • To analyse our services and products for improvement
  • To manage and operate this website (e.g. troubleshooting, data analysis, testing, research, etc.)

(d) Marketing and Advertisement:

  • To inform the Customers about the services and the products
  • To inform the Customers about our facilities, services, sales campaigns, etc. for marketing and advertisement purposes

(e) Other purposes specified when the personal date is collected

If we are to process the Customers' personal data for purposes other than the above, we will notify Customers in advance such new purposes of use and other matters as required by applicable laws.
By manifesting their intention to consent to this Privacy Policy, the Customers will be deemed to have consented to our processing of their personal data within the scope of the above purposes of use, and we will process the Customers' personal data based on such Customers' consent; provided, however, that the Customers may withdraw such consent at any time, which such withdrawal shall not affect any legitimate processing performed pursuant to the consent prior to the withdrawal.

We may also process the Customers' personal data within the scope of the above purposes of use in this Privacy Policy under a legal basis permitted by GDPR.
We may require Customers to provide their personal data in connection with the provision of the products and services.

In such case, if certain Customers do not provide their personal data, we may be unable to provide the products and services.

(5) Lawful Basis for Processing Personal Data

We will process the Customers' personal data on one or more of the following lawful bases:

(a) When the Customers’ consent is obtained to the processing
(b) When processing is necessary in order to perform or take steps to enter into a contract.
(c) We needs to process the data to comply with a lawful obligation
(d) The information is required to protect the Customers’, or a third party’s, vital interests.
(e) When processing is necessary for the purposes of the legitimate interests pursued by us or by a third party.

(6) Retention Period

We retain the Customers’ personal data for the period necessary to achieve the purposes of use described in this Privacy Policy (the “Retention Period”). When the Retention Period and the legally required period have elapsed, we will promptly delete or de-identify the personal data.

(7) Third Party Transfer

(a) Joint Use

We may share the Customers’ personal data with our group companies as follows:

  • Personal data items to be shared: Customer information such as names, addresses, dates of birth, contact details including telephone numbers and email addresses, occupation, transaction needs, etc.
  • Scope of joint use: Our subsidiaries and companies affiliated with the Yanmar Group.
  • Purpose of use: To achieve the purposes described in this Privacy Policy.

(b) Outsourcing

We may outsource tasks such as data processing to external contractors in order to provide better services and products. In doing so, we select contractors who handle personal data appropriately and ensure their proper management thereof by, for instance, concluding legally binding contracts with them to agree on necessary matters to protect personal data.

(c) Provision to Third Parties

We will not provide the Customers’ personal data to third parties except with their consent or as permitted by law.

We may provide the Customers' personal data to third parties which include those located in countries (including, without limitation, Japan) outside the EEA, and the Customers are deemed to have consented to the following matters by consenting to this Privacy Policy:

  • (a) Certain countries outside the EEA may not be furnished with the same level of data protection laws as the EEA, thus part of the rights granted to the Customers within the EEA may not be available;
  • (b) Customers' personal data may be provided and processed for the purposes specified in 1.(4) above; and
  • (c) Customers' personal data may be provided to third parties located in a country outside the EEA.
In addition to the above, if we are to transfer the Customers’ personal data to a third party located in a country outside the EEA, we will ensure that adequate measures are taken concerning the protection of the Customers' personal data such as by executing standard contract clauses based on the GDPR.

(8) Disclosure, Correction, and Other Procedures Concerning Personal Data

The Customers are entitled with the rights to access to, request for correction, request for deletion, request to limit the processing, object to the processing, and request for data portability, with regards to the personal data we hold pursuant to the provisions of relevant laws and regulations. Such requests shall be attended to the contact point set forth in "4. Contact" as per below.
We may charge the person requesting disclosure for the fees required. In such cases, we will notify the person of the fee requirement before asking for the payment thereof.
We may refuse the Customers' request if we deem that there is no basis for such request or if the request is deemed excessive.
The Customers may file objections to the data protection authorities having jurisdiction over the location of the Customers' domicile with regards to our processing of their personal data.

(9) Unsubscribing From Direct Marketing

If Customers wish to unsubscribe from our direct marketing, such Customers should contact the contact point set forth in "4. Contact" below.

(10) Usage of Access Log Information and Cookies

Our website uses cookies for the purpose of improving our website.

(11) Social Media Features

Our website may also include social media features, such as Instagram buttons. These features may collect the Customer's IP address, which page the Customers are visiting on Our website and may set a cookie to enable the feature to function properly. Social media features may be hosted by a third party. The Customer's interactions with these features are governed by the privacy policy of Our website providing it.

2. Safety Management Measures

We take technical and organizational security control measures to protect personal data from unauthorized access, loss, destruction, alteration and leakage, and to ensure its accuracy and security. For these purposes, we develop and maintain our administrative system and implement appropriate safety measures.

Also, as a physical and personnel security control measures, we will make effort to appropriately manage personal data by restricting the entry of unauthorized personnel into the offices where personal data is handled, conducting educational and awareness-raising activities for all executives and employees involved in personal data protection and appointing managers responsible for management of personal data in each department

If we, in our role as a Controller, contract a Processor, we shall select a Processor which is capable of implementing appropriate technical and organizational measures and shall manage such Processor in an appropriate manner. Pursuant to the GDPR, we shall prepare records of the processing of personal data.

3. Continuous Improvement

We continuously review and improve our personal data protection policies in response to changes in applicable Japanese laws (including the Act on the Protection of Personal Information), GDPR, handling procedures of personal information and the business environments, and therefore we may modify this Privacy Policy accordingly as needed. Any revision of the Privacy Policy after we decide its effective date will be notified by our prescribed means. Customers who continue to use our services and products on or after the effective date thereof are deemed to have consented to the contents of the revised Privacy Policy.
